Acceptance of Terms

By accessing and using the Pentaterraum Media website (pentaterraum.media) and any related services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use our services.

Eligibility

You must be at least 16 years old to use our services. By using our services, you represent and warrant that you are at least 16 years of age and have the legal capacity to enter into a binding agreement.

Services Description

Pentaterraum Media provides culinary education services, premium ingredient delivery, and exclusive dining experiences. We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

Account Registration

To access certain features of our services, you may be required to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Maintain the security of your password and accept all risks of unauthorized access
• Notify us immediately of any unauthorized use of your account
• Take responsibility for all activities that occur under your account

Payment Terms

For services requiring payment, you agree to pay all applicable fees and taxes. We use third-party payment processors to handle all financial transactions. All payments are final and non-refundable unless otherwise stated in our refund policy or required by law.

Cancellation and Refund Policy

Cooking Classes and Events

Cancellations made more than 72 hours before the scheduled class or event will receive a full refund. Cancellations made within 72 hours are non-refundable but may be rescheduled based on availability.

Ingredient Boxes

Subscription boxes may be canceled up to 7 days before the next scheduled shipment. Refunds are not available for boxes that have already been shipped.

Private Events

Cancellations for private events require 14 days notice for a full refund. Cancellations made within 14 days may be subject to a cancellation fee.

Intellectual Property Rights

All content on our website, including but not limited to text, graphics, logos, images, recipes, video materials, and software, is the property of Pentaterraum Media or our content suppliers and is protected by Canadian and international copyright laws.

You are granted a limited, non-exclusive, non-transferable license to access and use our services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content without our express written permission.

User Conduct

You agree not to use our services to:

• Violate any applicable laws or regulations
• Infringe upon the intellectual property rights of others
• Harass, abuse, or harm another person
• Transmit any viruses, malware, or other malicious code
• Attempt to gain unauthorized access to our systems or user accounts
• Interfere with or disrupt the integrity or performance of our services
• Collect or track personal information of others
• Impersonate any person or entity

Allergy and Dietary Disclaimer

While we take precautions to accommodate dietary restrictions and allergies, we cannot guarantee that our products are free from allergens. You are responsible for informing us of any allergies or dietary restrictions and for making your own determinations about the suitability of our products for your needs.

Limitation of Liability

To the fullest extent permitted by law, Pentaterraum Media shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use our services
• Any conduct or content of any third party on our services
• Any content obtained from our services
• Unauthorized access, use, or alteration of your transmissions or content

Indemnification

You agree to defend, indemnify, and hold harmless Pentaterraum Media and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of our services.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms of Service.

Governing Law

These Terms of Service shall be governed and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Dispute Resolution

Any dispute arising from these Terms of Service or your use of our services shall be resolved through binding arbitration in Toronto, Ontario, in accordance with the Arbitration Act of Ontario. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms of Service at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
